Taxes and currency
All prices quoted are inclusive of Goods and Services Tax (GST) and are in Australian dollars (AUD).
Disclaimer – purchase of artwork
It is possible that more than one person may attempt to purchase the same artwork at the same time via Octapod’s online shop.
If an intention to purchase an artwork is received from two or more prospective purchasers, Octapod reserves the right to sell the artwork to one purchaser at Octapod’s sole discretion.
If a prospective purchaser has initiated a transaction on Octapod’s website, they must immediately alert Octapod via email (email@example.com) and telephone (02 4021 1605), so Octapod may withdraw the artwork from sale in the website shop and at the exhibition.
Where an artwork is withdrawn from sale, Octapod will amend the website to reflect this within a reasonable time but cannot guarantee that it will be removed prior to a purchase being initiated online for the artwork. If a prospective purchaser has purchased an artwork via Octapod’s website that has already been purchased via the exhibition or has otherwise been withdrawn from sale by Octapod, the prospective purchaser will receive a refund of any amounts paid via PayPal through Octapod’s website.
Prospective purchasers otherwise acknowledge and agree that such refund is the full extent of Octapod’s liability to the prospective purchaser and that Octapod is in no way liable for any claim by the prospective purchaser in relation to its failure to secure an artwork.
Please also note that artworks may not look exactly the same as they appear on your computer. There is no substitute for viewing an artwork in person. As artworks are only available for purchase online during the exhibition period we encourage you to view them in person before making a purchase. Please remember that you cannot return an artwork simply because you change your mind.
Returns and refunds
Please choose carefully. Octapod does not give refunds if you simply change your mind or make a wrong decision. Should you receive an incorrect or faulty product, please immediately contact Octapod and we can arrange, as appropriate, either a refund, exchange or credit. Goods will not be accepted for return or refund later than 30 days of your receiving the goods.
Once you have received written confirmation of the return, simply mail the goods back. Address details will be provided in the confirmation email advice.
If you receive any product that is damaged, we will send you a replacement as soon as possible (depending on product availability) once we have received return of the damaged product. If your product is lost during shipment we will send you a replacement (depending on product availability) once we have waited for the maximum delivery time to expire. All replacement items for lost or damaged products will be shipped at our cost.
No refunds or exchange on sale items unless faulty.
If you are to receive a credit, this will be processed within 5 working days of our receipt of the goods.
Note: Shipping charges will only be refunded in the case that an error was the fault of Octapod. Octapod reserves the right to reject a return from anyone if any of the above conditions are not met or in the case of excessive returns.
Your order cannot be cancelled once the order has been shipped. The return policy conditions above will apply.
Purchase of Octapod and TINA T-shirts
If you ordered the wrong size T-shirt, all you will need to do is send the items back to us at the address on your invoice. Please include the invoice with the return along with a note indicating what you would like instead, or that you would like a refund.
All returned items must be in “as new” condition. “As new” means unwashed, unworn, and unmodified in any way.
Please note that in this case, we cannot refund shipping. All returns/exchanges must be submitted within 60 days of the date we ship out your order.
Payments via Octapod’s online shop are made via your PayPal account. Once you proceed with payment, you will be taken to the PayPal website to finalise your payment.
Limitation of Liability
Octapod, and/or its associated organisations and their employees and agents accept no liability or responsibility for any loss or damage whatsoever suffered as a result of direct or indirect access to the website, including by not limited to:
use or application of any material, publication or information made accessible via its website;
any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, line system failure, loss of data or loss of use related to the website.
Octapod respects your right to privacy and although not bound by, chooses to strictly adopt the Australian National Privacy Principles and the NSW Data Protection Principles when handling information about you. From time to time we conduct online surveys to assist us with planning our activities. We may ask if you want to add your email address to our enewsletter database. We do not pass this information on to third parties and do not sell or rent personal information to anyone and we take steps to ensure that it is stored securely.
